1.  Acknowledgement and acceptance of terms

McDaniel Coaching, LLC (“McDaniel Coaching”) is committed to protecting the privacy of users of the McDaniel Coaching website (the “Website”).  We will use reasonable efforts to see that all information, identifying and otherwise, submitted to us by users, remains private and is used only for the purposes for which you submit it and as set forth in this policy. This Privacy Statement sets forth our current privacy policy with regard to the information we collect when you or your computer interact with our web site.   By accessing McDaniel Coaching  / www.mcdanielcoaching.com,  you acknowledge and fully understand McDaniel Coaching’s Privacy Statement and freely consent to the information collection and use practices described in this Web Site Privacy Statement.

Please note that the Website may contain links to other sites that that we believe you might find useful.  Operators of linked sites may sometimes gather information from you.  We wish to caution you that you must take the responsibility for investigating, and must rely upon, the privacy policies of linked sites.  McDaniel Coaching has no control over such privacy policies or information submitted to linked sites.

2.  Information We Collect and How We Use It

McDaniel Coaching / mcdanielcoaching.com collects certain information from and about its users three ways: directly from our Web Server logs, with Cookies, and from the user.

a. Web Server Logs.

When you visit our Web site, we may track information to administer the site and analyze its usage. Examples of information we may track include:

  • Your Internet protocol address.
  • The kind of browser or computer you use.
  • Number of links you click within the site.
  • State or country from which you accessed the site.
  • Date and time of your visit.
  • Name of your Internet service provider.
  • Web page you linked to our site from.
  • Pages you viewed on the site.

b. Cookies

McDaniel Coaching may use cookies to personalize or enhance your user experience on the Website.  A cookie is a small data file that is placed on your hard disk by a Web page server.  Cookies cannot be used to run programs or deliver viruses to your computer.  Cookies are uniquely assigned to you, and can only be read by a Web Server in the domain that issued the cookie to you.  We use cookies to provide convenience and to save you time.  For example, if you personalize a web page, or navigate within a site, a cookie helps the site to recall your specific information on subsequent visits.  Hence, this simplifies the process of delivering relevant content and eases site navigation by providing and saving your preferences and login information as well as providing personalized functionality. 

McDaniel Coaching reserves the right to share aggregated site statistics with others, but does not allow others  to place cookies on our web site unless there is a temporary, overriding customer value (such as merging into mcdanielcoaching.com a site that relies on third-party cookies).

Users

The Website affords you the opportunity to submit your email address to us for the purpose of learning more about McDaniel Coaching and its services.  We use this information for the purpose for which you submit it -- to contact you with further information about us and our services.  We may send you emails, newsletters, announcements and other communications.  You have the right to opt out if you so choose by following the opt out instruction included in all emails from us.  We do not share the list of email addresses submitted through the Website with anyone, except in the circumstances noted below.  However, should you develop a further relationship with McDaniel Coaching, we may use, and share, your email address to further the purposes of our relationship.   We do share personally identifiable information in the following circumstances:

  • We may disclose information that we believe in good faith is appropriate to cooperate in investigations of fraud or other illegal activity, or to conduct investigations of violations of our Terms and Conditions of Use.  This means that if we conduct a fraud investigation and conclude that someone who has submitted information to us has engaged in deceptive practices, we may give that person’s contact information to interested parties who request it.
  • We may disclose information in response to a subpoena, warrant, court order, levy, attachment, order of a court-appointed receiver or other legal process, including subpoenas from private parties in a civil action.
  • We may disclose information to your agent or legal representative (such as the holder of a power of attorney that you grant, or a guardian appointed for you).

In the event all, substantially all, or a part of McDaniel Coaching’s business or assets or website are at any time sold, transferred, or disposed of (in accordance with legal proceedings, by merger, consolidation, or otherwise), or any such transaction is at any time contemplated or proposed, personal information, including identifying information, may, of course, become available to the purchaser or transferee or prospective purchaser or transferee and would be subject to its privacy policies.  McDaniel Coaching’s successors and assigns shall be entitled to the benefits of McDaniel Coaching’s rights under this document.

3.  Use of Web Beacons or GIF files

McDaniel Coaching /www.mcdanielcoaching.com web pages may contain electronic images known as Web beacons – sometimes also called single-pixel gifs – that allow McDaniel Coaching to count users who have visited those pages and to deliver co-branded services. McDaniel Coaching may include Web beacons in promotional e-mail messages or newsletters in order to determine whether messages have been opened and acted upon.

Some of these Web beacons may be placed by third party service providers to help determine the effectiveness of our advertising campaigns or email communications.  These Web beacons may be used by these service providers to place a persistent cookie on your computer.  This allows the service provider to recognize your computer each time you visit certain pages or emails and compile anonymous information in relation to those page views, which in turn enables us and our service providers to learn which advertisements and emails bring you to our web site and how you use the site.  McDaniel Coaching prohibits Web beacons from being used to collect or access your personal information.

4. Correcting and Updating Information

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online. Please note, however, that no transmission over the Internet can be 100% secure.  ALTHOUGH MCDANIEL COACHING WILL USE REASONABLE EFFORTS TO PROVIDE ALL OF THE FOREGOING SECURITY FEATURES, AND TO TREAT ALL DATA IN ACCORDANCE WITH THE POLICIES SET FORTH HEREIN, AS WITH VIRTUALLY ANY COMPUTER SYSTEM, THERE CAN BE NO ABSOLUTE ASSURANCE THAT SECURITY BREACHES WILL NOT OCCUR AND MCDANIEL COACHING HEREBY DISCLAIMS ANY LIABILITY WHATSOEVER FOR ANY SUCH SECURITY BREACHES.

6. Changes to this Statement

McDaniel Coaching has the discretion to  change and update this privacy policy.  When we do, we will also revise the “updated” date at the top of this Privacy page.  We encourage you to review this privacy statement from time to time to learn of any changes and to stay informed about how we are helping to protect the personal information we collect.  Your continued use of the Website constitutes your agreement to this privacy statement and any updates.

7. Severability

If any provision of this Privacy Policy shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent.
